These Terms of Service ("Terms") govern your use of CreateYourPool.com ("Site", "we", "us", or "our"). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, do not use our Site.
CreateYourPool.com provides AI-generated pool design visualizations based on photos you upload. We also connect homeowners with licensed pool contractors. Our service is for informational and visualization purposes only.
THE AI-GENERATED POOL DESIGNS ARE ARTISTIC VISUALIZATIONS FOR INSPIRATION PURPOSES ONLY. They are NOT architectural drawings, engineering plans, structural designs, or construction specifications. They do not account for local building codes, zoning regulations, soil conditions, utility lines, structural requirements, or any other factors relevant to actual pool construction.
You must consult with a licensed pool contractor, architect, and/or engineer before beginning any construction. CreateYourPool.com makes no representation that any design shown is feasible, safe, legal, or buildable on your specific property.
The actual appearance of a completed pool will differ from any AI-generated visualization. CreateYourPool.com is not responsible for any discrepancy between a visualization and the finished construction.
When you request contractor bids, we connect you with independent third-party pool contractors. WE DO NOT EMPLOY, SUPERVISE, ENDORSE, OR GUARANTEE THE WORK OF ANY CONTRACTOR.
We make reasonable efforts to work with licensed contractors but cannot guarantee their licensing status, insurance coverage, quality of work, pricing, availability, or conduct at any given time. You are solely responsible for verifying contractor credentials, checking references, reviewing contracts, and making your own hiring decisions.
CreateYourPool.com is not a party to any agreement between you and a contractor. Any disputes, claims, or issues arising from contractor work are solely between you and the contractor. We have no liability for any contractor's actions, omissions, or work product.
All payments for design packages are final and non-refundable. Because our service delivers digital AI-generated content that is created immediately upon purchase, we do not offer refunds once designs have been generated. If you experience a technical issue preventing design delivery, contact us at support@createyourpool.com and we will work to resolve it.
By uploading photos to our service, you represent that you own the photos or have the right to use them, and you grant us a limited license to process them solely for generating your pool designs. You must not upload photos of properties you do not own or have permission to photograph. We are not responsible for any privacy or legal issues arising from photos you upload.
You may not use our service to upload illegal content, attempt to reverse engineer our AI systems, resell or commercially distribute designs without permission, or use automated tools to access our service at scale.
OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DESIGNS WILL MEET YOUR EXPECTATIONS. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATEYOURPOOL.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, CONSTRUCTION COSTS, CONTRACTOR DISPUTES, PROPERTY DAMAGE, OR ANY DAMAGES ARISING FROM YOUR RELIANCE ON AI-GENERATED DESIGNS.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF OUR SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, OR $50, WHICHEVER IS LESS.
You agree to indemnify and hold harmless CreateYourPool.com, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, your uploaded content, or your interactions with contractors.
These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Palm Beach County, Florida.
We may update these Terms at any time. Continued use of the service after changes constitutes acceptance of the new Terms. We will update the "Last updated" date at the top of this page.
